General Terms Quality of Source Material: The final quality and detail of your commissioned artwork are directly dependent on the clarity and detail of the original reference materials you provide. High-resolution images and clear instructions are highly recommended. Artist's Signature: All completed artworks will include the artist's signature, which is an integral part of the piece and may not be removed or obscured by the client. Process Documentation: The artist reserves the right to record the creation process of commissioned artwork (e.g., time-lapses, progress shots) and to share these recordings on social media platforms, the artist's website, or other promotional channels. Clients who prefer their commission not be recorded or shared must discuss this with the artist prior to the commencement of work. Pricing: All prices for commissions are subject to change based on demand, artistic complexity, and material costs. Quotes provided are valid for a specified period, as communicated by the artist. Right of Refusal: The artist reserves the right to decline any commission request at their sole discretion, for any reason, without obligation to provide an explanation.
2. Payment Accepted Currency & Methods: Payments are accepted in either United States Dollars (USD) or South African Rands (ZAR). Accepted payment methods include PayPal, South African payment services, or direct bank transfers. Specific payment details will be provided upon confirmation of your commission slot. Payment Schedule: Clients may choose to pay either 100% of the commission fee upfront or as a split payment of 50% upfront and the remaining 50% upon final delivery of the artwork. Commission Slot Confirmation: Please don't send any payment until the artist has confirmed your commission slot and formally requested payment. Detailed payment instructions will be sent to you at that time.
3. Process and Delivery Commission Commencement Notification: The artist will notify you once work has officially begun on your commission. Review Stages: Throughout the creation process, the artist will provide progress updates and conduct reviews to ensure the artwork aligns with your vision. The number of reviews will depend on the complexity of the commissioned piece. Work-in-Progress Images: During review stages, work-in-progress images will be provided. These images will typically be watermarked and may be lower resolution than the final artwork. Completion Timeframe: The time required to complete a commission varies, typically ranging from 2 days to 1 month. This timeframe is subject to factors such as the artist's health, the intricate details of the piece, and current workload. Communication of Delays: Should any unforeseen circumstances arise that may delay the initially estimated delivery time, the artist will communicate this to you as soon as possible. Final Delivery: Upon completion and final payment, you will receive your finished artwork. For physical pieces, tracking details will be provided upon shipment. Digital artwork will be delivered via a secure link.
4. Revisions Included Revisions: The commission price includes up to three (3) minor revisions, strictly limited to the early sketch stage. These revisions cover small adjustments to composition or elements. Fee for Significant Changes: Any substantial changes requested after the initial sketch approval, or significant alterations to the final drawing, will incur an additional fee. Post-Approval Changes: Should you request changes to a drawing that you have previously approved, a fee will be charged based on the time spent and the cost of any additional supplies required. Unclear References: If the provided reference material is unclear or insufficient, resulting in the need for significant adjustments, additional charges may apply. AI-Generated References: References derived from Artificial Intelligence (AI) will not be accepted for commissions.
5. Copyright and Usage Policy Artist's Rights (Kreuben Moodley): Unless explicitly agreed otherwise in writing, Kreuben Moodley retains all intellectual property and copyright rights to the commissioned artwork. This includes, but is not limited to, the right to: Promote the artist's work across all platforms. Publish the artwork in books (e.g., art books, portfolios). Display the artwork on websites, social media, and in physical exhibitions. Utilize the artwork for the creation and sale of prints, stickers, and other merchandise. Buyer's Permitted Usage: The buyer is granted a non-exclusive, non-transferable license to use the commissioned artwork for personal, non-commercial use only, unless otherwise specified in a separate agreement. Permitted personal uses include: Uploading the artwork to your personal social media profiles, forums, and personal websites. Using the artwork to promote yourself (e.g., as a profile picture). While not mandatory, crediting the artist is highly appreciated. Using the artwork on your personal YouTube channel and in monetized videos, provided the artwork itself is not the primary subject or source of the earnings (e.g., background art, fleeting appearance). Copyright Infringement (Prohibited Actions): The following actions are considered copyright infringement and are strictly prohibited: Reproducing, distributing, or using the copyrighted artwork for any commercial purpose (i.e., making money from it in any way) without express written agreement from the artist. Claiming the artwork as your own creation. Removing or obscuring the artist's signature from the artwork. Altering the artwork in any way without the artist's prior written consent. Commercial Rights: The full commercial rights to the artwork may be purchased from the artist at any time through a separate agreement.
6. Commitment to Satisfaction: The artist is committed to ensuring customer satisfaction and will make every reasonable effort to achieve it. Open Communication: If you encounter any problems or have concerns regarding your commissioned piece, please contact the artist immediately to discuss and find a mutually agreeable solution. Negotiation of Terms: Certain terms may be modified or custom agreements made if discussed and agreed upon with the artist before the commission work begins. For example, if you prefer that your artwork not be posted publicly, this can be negotiated.
7. Refund and Cancellation Policy No Refunds After Commencement: Once the artist has begun work on a commission, the buyer is not entitled to a refund. Full Refund (Artist's Inability to Start): If, for any reason, the artist is unable to commence work on your commission, you will receive a full refund. Full Refund (Client Cancellation Before Start): If you, the client, cancel your order before the artist has started working on the commission, you are eligible for a full refund. PayPal Chargebacks: In the event of an authorized refund, the artist will process the transfer directly back to you. Do not initiate a PayPal chargeback. Consequences of Unauthorized Chargeback: Should you initiate a PayPal chargeback for which you are not entitled to a refund under these terms, you will forfeit all previously mentioned rights to the commissioned artwork. The artist will then have the full right to profit from the artwork in any manner deemed fit. The artist will decline the chargeback and provide PayPal with all relevant communications and evidence of work completed as proof of service. Furthermore, you will be permanently blacklisted from commissioning the artist again. Acceptance of Terms: By proceeding with a commission or using this website, you acknowledge that you have read, understood, and agree to these Terms and Services.
